President Trump is a fresh push for the abolition of ObamaCare, followed a difference of opinion within the administration, with top officials and Vice President of Pence advice against such a step, according to multiple reports.
The trump administration on Monday said a Federal appeals court that the whole Affordable Care Act should be abolished, with the Department of justice lawyers, the filing of the letter with the U.S. Court of Appeals for the Fifth Circuit in New Orleans the agreement with a ruling by a Federal judge in Texas last year that the health care law is unconstitutional.
“The Ministry of justice has determined that the district court be affirmed to the judgment. Because the United States is not urging that they be made a part of the district court judgment reversed, the government will file a brief on the defendants’ time to plan,” read the filing.

The decision to support the overall tilt of the law was to Trump sided with the White house, the acting chief of staff Mick Mulvaney, a staunch critic of the Obama-era health care program, rather than following the advice of the Minister of justice, William Barr, and health and Human Services Secretary, Alex Azar, warned two reports prior to that.

Trump was apparently encouraged by Mulvaney and saw the movement as a way to his election promise to overturn ObamaCare in its entirety instead of only partially disassembling the system — negating the penalty on the individual mandate.
But the health Minister insisted that if a lawsuit to repeal the health care law is untenable, since there is no Republican alternative, according to Politico. Mulvaney according to reports, the concerns, the claim that such a bold move would force Congress to come up with alternatives.
Barr, who was recently praised by Trump about dealing with the end of the Robert-Müller probe, allegedly, unilaterally, against the trump card, namely, the effort is doomed to fail, as the Supreme court has already the legality of the law confirmed.

Trump talked about ObamaCare on Wednesday, but did not address the disagreement within the government.
“ObamaCare is a disaster. It is too expensive, by far. People who can’t afford it and the deductible is terrible,” Trump said in the Oval Office. “The premiums are too expensive. The people are broke trying to pay for it.”
“If the Supreme court decides that ObamaCare is, we have a plan that is much better than ObamaCare,” trump added.
“If the Supreme court decides that Obamacare is, we have a plan that is much better than Obamacare.”
The Department of Health and Human Services provided a statement to Politico, to deny any rift in the administration.
“Secretary Azar supports the Administration and litigation position in the ACA-a case that bears his name,” said an Agency spokeswoman. “Any insinuation that the Secretary Azar has butted heads” with Mulvaney on this issue is wrong.”

U.S. district judge Reed O’connor ruled last year that ObamaCare is not constitutional because the tax reform package as prescribed, by the Republicans – eliminates the health care law, the penalty for not having health insurance.
The administration initially insisted that only certain parts of the law should be declared invalid. But the latest filing is moved to the previous position, and includes the whole of the tilting of the law.
The submission pointed out that the government will make a brief in support of Texas-led coalition of States, which is trying to overthrow the health-care law, given that “the United States is urging that they be made a part of the district court’s judgment reversed,” reported the Washington Post.

“The judiciary has determined that the land court in its comprehensive opinion to the correct conclusion and support it on appeal,” Kerri Kupec, a spokeswoman for the Ministry of justice, told the newspaper.
