The Trump administration has new political leadership on Monday, the tightening of the rules for the award of discretionary work permits for immigrants who are temporarily in the United States for “urgent humanitarian reasons or significant public benefit” under the Immigration and Nationality Act.

The move came a week after the White house a long-awaited rule, was the strengthening of the ability of Federal officials to deny green cards for immigrants deemed likely to rely on government assistance.

Section 212(d)(5)(A) of the Immigration and Nationality Act) provides the Department of Homeland Security the right to decide when to afford aliens entry under “exceptional” circumstances, such as to visit a dying relative, or you will receive life-saving medical treatment. The one-time-entry is a privilege, not a right — and management, the leadership made it clear that the officials were suspicious-it was abused.

U.S. citizenship and Immigration Services (USCIS) said, the new leadership emphasizes “the use of discretion in the decision on the grant of employment authorization for foreign nationals, the parole in the United States in accordance with the existing policy.”

The bulletin also contains “a list of positive and negative factors an officer may consider when weighing the totality of the circumstances and determining whether a candidate is guaranteed a favorable exercise of discretion,” according to USCIS.


“USCIS has determined that it is necessary to have this guidance at this time because it is a national emergency at the U.S. southern border, where foreign state, the Agency said relatives in the United States illegally,” in a statement.

The White house has announced that its tough immigration policy is the cause for the recent decline in immigrant arrests at the border. The number of migrants encountered by U.S. authorities on the border with Mexico fell to under 100,000 for the first time in five months amid a strengthening cooperation between Mexico and Guatemala to crack down on the flow of humanity, according to government data released earlier this month.

2020 presidential hopeful Sen. Kamala Harris, D-Calif., called the move part of a “campaign of terror.”


Acting Homeland Security Secretary Kevin McAleenan stressed last week that despite the successes, the situation remains an emergency.

“The situation is improving by every available metric, however, and I want to be very clear about this, we will remain on the and-crisis level,” McAleenan said.
