ALBUQUERQUE, N. M. – The Latest on the case of a New Mexico man who killed five members of the family as a teenager (all times are local):

A New Mexico judge has ordered a young man who killed five members of the family as a teenager to remain in custody, while his young sense is assessed.

Judge Michael E. Martinez on Thursday ordered Nehemiah Griego will be immediately transferred to an adult prison, pending the outcome of his case.

Griego was previously set for release on Tuesday his 21st birthday, on the basis of a ruling two years ago that he was receptive to treatment in state custody and can be sentenced as a minor.

But a court of appeal recently overturned that sentence, resulting in a new round of hearings. That procedure could take weeks, if not months.

Prosecutors asked to have Griego remain in custody until his case is resolved. Griego’s attorneys argued that he has received hundreds of hours of individual, group and family therapy, while in the state of preservation.

One of the Children’s hearing for Nehemiah Griego is scheduled for Thursday afternoon in Albuquerque. He had earlier planned for a release on Tuesday his 21st birthday, on the basis of a ruling two years ago that he was receptive to treatment in state custody and can be sentenced as a minor.

But a court of appeal last week overturned the ruling, resulting in a new round of hearings in Griego’s case.

The proceedings before the district court could take weeks, if not months. And prosecutors want a judge to Griego remain in state custody until his case and sentence has been resolved.
