A Pentagon official says that he can’t respond to a lawsuit filed by three of the major cities in the US that says that the military does not make good use of the national background check system for guns.

New York City, San Francisco, Philadelphia, filed the lawsuit Tuesday in Virginia. The cities argue that the Ministry of Defence has failed to “large numbers” of disqualifying records to the FBI’s national background check system for gun licenses and the sale. That is not allowed a disgraced former air force member to buy a gun and shoot 26 people to death Nov. 5 in a Texas church.

Pentagon spokesman Tom Crosson says the department is continuing to work with the US military leaders to refine their policy.

Local law enforcement officials to rely on the FBI database for background checks on gun permit applications and to check purchases. The lawsuit says that it must be up-to-date.

The federal officials will not comment directly on the lawsuit.
