The Latest: the Defense calls Van Dyke “a scared police officer’

CHICAGO – The Latest on the trial of a Chicago police officer charged with murder in the shooting of black teen Laquan McDonald (all times are local):

A lawyer for a white Chicago police officer charged with murder in the 2014 shooting of black teen Laquan McDonald says the agent “acted as he was trained to do.”

Lawyer Daniel Herbert says Officer Jason Van Dijk was afraid of the police-officer, who was fearful for his life and the lives of others,” as he opened fire on McDonald. Herbert made the remarks during opening statements Monday at Van Dijk on the test.

Prosecutors earlier had shown showed video of the shooting. It shows Van Dijk shoot McDonald 16 times as the 17-year-old boy who runs away from officers. He wore a small knife.

Herbert said McDonald had tried to attack a truck driver with his knife. But special prosecutor Joseph McMahon, called the shooting “totally unnecessary.”

Prosecutors are showing jurors video of a white Chicago police officer fatally shooting black teen Laquan McDonald.

The prosecutors showed the video 15 minutes into opening statements Monday in the trial of the Officer by Jason Van Dijk. It shows Van Dijk shoot McDonald 16 times as the 17-year-old boy who runs away from officers.

Special prosecutor Joseph McMahon, called the shooting “totally unnecessary.” He said McDonald was armed with a 3-inch (7.5 cm) knife, when Van Dyke shot him. McMahon, says Van Dijk started with the firing of six seconds after getting his patrol car.

The defense is set to the opening statement after the prosecutors finish of them.

Judge Vincent Gaughan on Monday denied a defense request to move the trial of Chicago.

A judge has decided that the murder trial of a white Chicago police officer charged in the 2014 shooting death of a black teenager should not be moved out of the city.

Cook County Judge Vincent Gaughan announced his decision on Monday morning.

Defense attorneys asked the trial be moved, because the extensive publicity since 2015 the release of the video that shows Officer Jason Van Dijk shooting 17-year-old Laquan McDonald 16 times makes it impossible to find impartial jurors is required for a fair trial.

But lawyers were able to select a jury in less than a week.
