The judges are struggling with malpractice claims in the Jodi arias case

PHOENIX – court of appeal judges who will decide whether or not to turn Jodi arias’ murder conviction in the grisly 2008 slaying of her ex-boyfriend, and grappled on Thursday with who was in charge of whipping up the publicity during the provocative test, and whether or not the alleged misconduct of an attorney should be up to the judge to be thrown out.

An attorney for arias, told the Arizona Court of Appeals that the prosecutor, Juan Martinez, improperly questioned witnesses, ignored the rulings on the evidence, to the court publicity and it was an unsubstantiated allegation that the expert on her defense team have had an inappropriate relationship with arias.

“The theme of the public prosecutor, the case was this: Everyone needs to ignore you, but to me,” said Cory Engle.

Terry Crist, an attorney for the Arizona attorney general’s office, told the judges that he shall be a believer Who is in violation of the rules of the court, but none of his actions have led to a reversal of the conviction.

“The evidence of guilt is strong, in this case,” Crist said.

She is serving a life sentence for the first degree murder conviction in the death of Theo Alexander at his home in a suburb of Phoenix, Mesa is.

The prosecutor said arias was violently attacked Alexander in a jealous rage after he wanted to end their affair and planned a trip to Mexico with another woman.

Arias has acknowledged killing Alexander, but claimed that she acted in self-defense after he attacked her. He was stabbed nearly 30 times, had his throat slit, and was shot in the head.

The guilt phase of arias’ trial ended in 2013, with the jury convicting her of murder, but deadlocking on the penalty. A second sentencing trial that ended in the beginning of 2015, with a different jury deadlocked, leading a judge to sentence arias to life….

The case turned into a media circus as salacious and violent details about arias and Alexander were broadcast live around the world.

She was active in the court of the spotlight since 2008, she was arrested. She did interviews on TV’s “48 Hours” and “Inside Edition” after her arrest and on the witness stand for a couple of weeks during the trial. She also did a series of interviews with members of the media after her conviction.

Arias and Martinez were not present in the courtroom for Thursday’s hearing.

Engle said ” Who are activated in the field of advertising, and even went so far as to sign autographs and for photos with fans outside the courthouse. She is known for her client to court publicity.

“It does not appear that she ever gave in her desire to get her story out,” Judge, Jennifer told Him.

Mr Campbell asked what the judges should do when an officer of justice, “that is, an actor on the stage, loving the publicity?”

Mr. Crist said that the judges are able to maintain belief in such cases, and still the public prosecutor for the State Bar of Arizona for potential discipline.

Was brought up in a sidebar conversation between the attorneys and the judge in the arias trial, in which Martinez is profanely said to be one of the defense attorneys that if he were married to her, he would kill himself. The prosecutor apologized after a complaint was made.

Mr. Crist said that the encounter took place outside the presence of the jury.

Judge Kenton Jones, asked whether such conduct by a prosecutor, it is acceptable if members of the jury, not the witnesses. “It’s not right at all,” Crist replied.

The judges have to say when they would make a decision to do so.

After arias’ attorney filed an appeal of the new complaints were filed against Martinez, even though none of them have been raised in this case.

A court that hears disciplinary cases against lawyers in this summer, threw out the accusations that the Who made sexually inappropriate comments to female law clerks in his office, and had inappropriate contact with a woman who was fired from the works by jury, and later texted nude pictures of himself to the public prosecutor’s office.

The other charges against Martinez’s attorney in a disciplinary matter is recorded, and claims that the public prosecutor’s office is leaking to another member of the jury the identity of a blogger with whom, Who was having a sexual relationship with you.

Martinez was reprimanded by the district prosecutor’s office in 2018 and for inappropriate and unprofessional behaviour towards a female law clerks.
