HOUSTON – Houston-area man whose life prison sentence for the 1999 killing of his pregnant wife, was cleared by Texas’ highest criminal court has been freed on bond.
David Mark Temple, walked into the Harris County Jail late Wednesday afternoon after nine years in a Texas prison.
The Texas Court of Criminal Appeal last month ruled the outcome of the Temple of the trial would have been different as a Harris County prosecutor had not withheld evidence from his lawyers and had published other to prove to them early.
Prosecutors accused the Temple of organising a break-in at his suburban Houston home and fatally shooting his wife, Belinda, because he had an affair. She was seven months pregnant. He was not charged until five years later.
The temple is by the court next week for a hearing.
