A judge on Tuesday dismissed charges in a Tennessee mom who was arrested after a viral video, Facebook Live, let her have her 1-month-old baby in the air with one hand, while blowing smoke in her face before she put her in for a kiss.

Tybresha Koster, 24, was charged with aggravated child abuse after the Chattanooga police department responded to a number of complaints from people who saw the video, according to a new report by the WTVC.

When the police arrived at her apartment on Sept. 29, they allegedly had the odor of alcohol on her breath, and she told officers she “didn’t want to that’s f – – – – – – – – – g a baby, anyway,” according to an arrest affidavit.

Several neighbours showed it to the officers of the 30-minute-long video, which was for the Clerk and grabbed her daughter by the arm and lifted her into the air.

She was also charged with resisting arrest and disorderly conduct.

Assistant District Attorney Ben Boyer told the Judge, Alex McVeigh, during a hearing in Hamilton County criminal court (icc) even though the video was “disturbing,” the prosecution thought that it would fall short of meeting the burden of proof to make the charges stick — neglect.
