Whether or not the existing house effort is officially a law enforcement investigation is more than just semantics. For Nadler, the secret “grand jury” material of Mueller’s investigation, he must show that his situation falls under one of the specified situations described by the Federal Rules of Criminal Procedure. During the investigation of President Richard Nixon, a court judgment determined that the impeachment investigations fall under the category of “judicial proceedings” and thus qualifying for the disclosure of the secret information.
