He says that the boy hit his head on a wall while Weaver turned him around, playing what they called “the Superman game.” The lawyer says that the 38-year-old Dayton man was in a panic and that is the reason why he initially told the police that the boy fell.

The coroner says that the child, 20 head injuries, a serious arm burn and injuries to his back. The plaintiffs argued that the Weaver could not explain it, the burning, and had never been treated. The boy died from a severe skull fracture in November 2015.

The weaver woman was found guilty of child endangering.

Their sentencing is scheduled May 5.
