The Senate on Tuesday President Trump confirmed to be nominated, a judge on the liberal Ninth Circuit Court of Appeals in a party-line vote-and, in a historic stump, the White house, the entry, the judge ignored the two Democratic home-state senators in the process.

To give the aggressive and unprecedented move, the so-called “blue slip” process of consultation, the slip comes as the Trump administration is trying to undermine the left-wing dominance in the key court of appeal, the trump has called the color “shame” and politically biased.

With a broad scope of nine Western States represent, the court of appeal has long been a thorn in the side of the Trump White house, with decisions against its travel ban policy and the limits of the funding to “sanctuary cities.”

The Seattle lawyer, Eric Miller, has been confirmed 53-46. Miller was one of the 51-Federal judicial nominees left over from the previous Congress, which the White house nominated again, in the last month.

Among these objections, the two Democratic senators Maria Cantwell and Patty Murray of Washington State. Helpers say, Miller’s confirmation is the first time the Senate has the tradition and confirmed a judicial nominee on the dissent of the two home-state senators.

“This is wrong. It is a dangerous road to go to the Senate,” said Murray on Tuesday in the Senate. “The confirmation of this Ninth Circuit court nomination without the consent or true input of the home-state senators, and, after a sham hearing, would be a dangerous first for this Senate.”

Miller was nominated last year, but faced opposition from Democrats, over his views on the issues of tribal sovereignty.

The Sacramento Bee reported that last year, White house officials had broken the negotiations with California Sens. Dianne Feinstein and Kamala Harris about the Ninth Circuit appointments, but the dialogue together, and the White house was to announce three nominees about their objections.

These nominees — Patrick Bumatay, Daniel Collins and Kenneth Kiyul Lee (all from the “Golden State”, and supposedly all the members of the conservative Federalist Society) – have yet to be confirmed.

GOP critics branded, the court, the “Nutty Ninth,” in part because many of his judgements have been overturned by the Supreme court.
