Housing and urban development (HUD) Secretary Ben Carson rolls wants to back an Obama-era rule mandating that single-sex homeless shelters funded by his Department to give residents based on their stated gender identity instead of their gender at birth, with the argument that people could be intentionally false information about their gender for malicious reasons.

In a new rule, published online on Wednesday, HUD said, she wants you to give to the shelters it funds the flexibility in developing their own strategies for admissions at single-sex or sex-segregated shelters.


A Senior HUD official told Fox News: “The Federal government does not have to be the bathroom police.”

HUD said the change is necessary because of the Equal access rule under the Obama administration “leaves no room for the shelter-provider, decisions about potentially dangerous individuals, the premises may be false information about their gender access to gender-specific protection.”

“Further, the HUD, the current rule can not be retrieved over the practical needs of the homeless providers that serve vulnerable clients in difficult circumstances, including those seeking refuge from abusive relationships or domestic violence”, according to a department fact sheet, provided by Fox News.

The proposed scheme would allow shelter providers to consider a number of factors, when it comes to determining the gender of a person, including “privacy, security, practical concerns, religious beliefs, all the relevant considerations, civil rights and non-discrimination authorities, the individual sex-as reflected in official documents of the government, as well as the gender of the person with which it is identified.”

But transgender activists said they fear that the result in transgender will-persons denied equal spaces and equal access to protection.


“This is a heartless attack on some of the most vulnerable people in our society,” said Mara Keisling, the executive director of the National Center for Transgender equality. “The programs affected by this regulation of life and death for transgender people, especially the youth rejected by their families, and a lack of stable housing is fuelling the violence and abuse that takes the lives of many transgender people of color across the country.”

HUD said it would continue to ensure the Department policy “that its programs are open to all eligible individuals and families regardless of sexual orientation or gender identity.”

The Department has also argued that the rule of flexibility for faith-based providers would change, namely the current rule, you can.of which is seeking HUD funding to hold because of their religious beliefs

The Department cited a lawsuit against Naomi’s House, California, the homeless shelter that receives HUD funding, where nine women claimed the, a biological man who identifies as a female, made lewd comments, as he was in the shower with the other residents. The proposed rule change came when Carson weathered harsh criticism this week from Democrats during an appearance before the House Financial Services Committee, as he answered questions about a proposed rule change that strips the public housing assistance for illegal immigrants would.
