You can understand why so many people are confused this week.

The Congress is out of session.

But then, the house retains a meeting, trying to pass a $19.1 billion disaster bill, in the almost no members present on the floor. Then a couple of Republicans to stymie the bill. This sets off the howl of protests from Democrats and a few GOPers. The house may not be aware of the disaster package for people needing relief from hurricanes in the South and floods in the Midwest of the USA

So, although the house is “out” meeting this week, everyone will just have to wait until the house is back in session next week and try again.

The house is also outside of the meetings this week? Kinda-sorta.

Let’s review:

The house and the Senate are technically “out” meeting this week. Both bodies usually ditch Washington for the Memorial Day break. But neither the body is really off the hook this week.

We go to the Constitution.

Article I, section 5 of the Constitution States that “Neither house, during the session of Congress, without the consent of the other, adjourn for more than three days….”

In other words, if either body want to shake to, the city for 72 hours, would surely have the blessing of the other.

To do So, must both of the resolution meeting, the house and the Senate, which is considered a “postponement.” From time to time, the house and Senate approve the adjournment resolutions, and really have to go to niche for more than a few days. To approve the house and Senate often, the postponement of Thanksgiving and Christmas, sometimes in the spring, when the legislature in between decisions to be absent for more than two weeks around Easter and Passover, for the fabled “August recess” and a variety of other times.

The Congress is not yet approved, many of adjournment resolutions late.

During the Obama administration, the Republicans in Congress were scared to get on, for more than three days. An adjournment resolution would have put GOPers on the possibility that President Obama could-in closet to fill a key or judicial position with a “recess appointment.” The Constitution allows to bypass the President of the Senate the confirmation and directly install, the people in management posts when the Senate adjourned.

These days, Democrats fear that President Trump could try an end-run around the Senate and the different recess dates. So, the Democratically controlled house has no interest in the approval of an adjournment resolution.

So, what does the Congress do, if he wants to take a break, and is not convened for a few days?

Easy. The house and the Senate majority leader does not plan, large floor-to-activity for a week or so. But, the house and Senate meet at three-day intervals is set forth to satisfy the Constitutional requirement, article I, section 5.

These regular meetings are often meetings as a “pro-forma” -. The back is where the house and the Senate, for anywhere from 30 seconds to a few minutes – and immediately gavel. The Senate often is the Hammer, Hammer out callisthenic with only one senator leads present. The house can do the same, but sometimes two or three legislators to show.

“Pro forma” is Latin for “as if.” So, if the house and the Senate convene in this abbreviated meeting, it is as if ” all members are there. But don’t expect that all of the legislative business.

As a General rule.

This is what brings us to the house, try to approve a bill with a little more than a few members on hand.

The Senate fought week-long disaster relief, passed the bill. President Trump and many Republicans hope to lock the border security and humanitarian aid to the measure. But Democrats protested. Senate Majority Leader Mitch McConnell, R-Ky., declares that the Senate would vote on something in connection with disaster relief before the Memorial Day break. The house was planned to leave the city, lunch on Thursday, may 23. A Senate, the deal finally came together in the early afternoon of the 23rd. The Senate approved the measure, 85-8. But, most of the members of the house had dashed for the exits — it’s ready to be back in their districts for Memorial Day parades, and other services.

Because the legislature never considered an adjournment resolution for the “recess”, both the house and Senate were ready to meet in short sessions on Friday, 24. The Senate gaveled in and gaveled out. But the house had hoped to align with the Senate and pass the disaster bill.

Three members of the Friday morning were present: Reps. Jim McGovern, D-Mass., Donna Shalala, D-Fla., and Chip Roy, R-Texas. The house would never be a full roll-call vote on a topic, the only three people in the chamber. This would mean that only three people are on the record, for or against a bill, and 430 other members of the house. To approve so if there is any business that tries to home in the rule, the legislation on the “unanimous consent.” In other words, all must agree with members on the floor. The vote must be “unanimous.” But if a legislator objects, it’s not unanimous. The bill is stalled.

Shalala asked to approve the house, the disaster bill by unanimous consent. Roy objected.

The scenario repeated itself on Tuesday afternoon.

Sanford Bishop, D-Ga., asked to approve the house, the disaster legislation by unanimous consent. Rep. Thomas Massie, R-K. Y., and Alex Mooney, R-W. Va., of the showed. So, eight of the legislator appeared for two different sessions, as they tried to the house, to advance a bill. Most of the members would you say that the Congress was on “Pause.” Many helpers were on holiday. Some of the doors and passageways in and around the Capitol have been blocked. Only a few members of the Capitol press corps showed up.

But the house was really “on break?” Not really. The house was to tackle legislative business. There were a lot of members. Both short house sessions lacked, as a rule, in the name of splendor. But, it’s hard to really say that the house was “out”. And the Congress does not approve, certainly, an adjournment resolution, to grant the two-body exit.

Hoyer says the house will attempt to pass the disaster bill again on Thursday. And if not, is the full House vote on the measure next week, when back all.

After all, the Congress was out of session. Kinda-sorta. But, paradoxically, also in the meeting. Kinda-sorta.
